CW33/BEST BLUEBONNET “PEE WEE PATRIOT SWEEPSTAKES" (Sweepstakes) is sponsored by CW33 (KDAF-TV) and Blue Bell "Sponsors" whose joint decisions regarding all aspects of the give-away shall be final and binding in all respects. Sponsor reserves the right to change the rules at any time without notice.
SWEEPSTAKES DATES:
Monday, June 25, 2012, 8:00:00am (CT) through Sunday, July 8, 2012 11:59:59pm (CT) (Sweepstakes Dates).
HOW TO ENTER:
NO PURCHASE NECESSARY. One valid entry per Entrant. Visit cw33.com and upload the best photo of your child or children showing their Patriotic spirit. To upload photos, register at cw33.com (using a valid email address is required). Obscene or inappropriate photos will be disqualified. Sponsor is not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of Man or God. By entering, you are verifying that you are the owner of the photos and that no third party ownership rights exist to the photo submitted. Inappropriate or indecent photos will not be uploaded and will be disqualified. Photos will be screened and published by CW33 on a daily basis (except for weekends, photos will be uploaded on Monday at the latest). Latest entry can be received on Friday July 6th at 04:00:00pm, and voting will end on Sunday, July 8th at 11:59:59pm. Odds of winning depend on the number of eligible entries received.
WINNER SELECTION AND NOTIFICATION:
All photo entries that comply with applicable sweepstake rules will be eligible for voting consideration. Visitors to cw33.com will be allowed to vote unlimited times for their favorite photos during Sweepstakes Dates. The account (person) with the most valid votes at the end of the Sweepstakes will be named the Winner.
One (1) Prize Winner will be notified by Monday, July 9, 2012 via email. Winner must acknowledge notification within 24 hours by calling (214) 252-3452. Sponsor will be the sole and final judge of eligibility, winner verification and all other matters connected with the Sweepstakes. Winner must meet and agree to all eligibility requirements, terms and conditions mentioned in Official Rules. Winner will be awarded Prize upon verification of eligibility requirements and all results are unofficial until winners respond to e-mail notification. Return of any prize notification as undeliverable may result in forfeiture. If a winner cannot be contacted or reached within 24 hours of the first notification attempt, declines the prize, or is deemed ineligible to participate, then he/she will be disqualified and Sponsor may choose an alternate winner. If Sponsor cannot find an eligible winner for the prize, that prize will not be awarded.
PRIZE:
One (1) Winner will receive Blue Bell Ice Cream for one year in the form of Twelve (12) certificates redeemable for 1/2 Gallons of Blue Bell Ice Cream at local grocery stores. Certificates are valid for One (1) year from date of acceptance. Winner MUST claim prize at CW33 Television Station, 8001 John Carpenter Freeway, Dallas, Texas. Sponsor will not replace any lost or stolen prizes once they are in the prize winner's possession. Federal, state and local taxes, if any, are the responsibility of the winner. By accepting the prize, winner assumes full responsibility for all applicable income taxes, sales taxes, insurance, option/upgrade costs, and other charges that may apply. Prize ARV: $85.00.
ELIGIBILITY RESTRICTIONS:
This Sweepstakes is void where prohibited or restricted by law. To enter, you must be 13 years of age or older and reside in the Dallas/Ft. Worth television market in Texas, as defined by The A.C Nielsen Company. Only one registered account per voter. Employees of CW33 (KDAF-TV) and Tribune Broadcasting and Blue Bell (Sponsors), their subsidiaries, affiliates and advertising agencies are not eligible to win. Such employees' immediate family and household members also are ineligible to win.
CONDITIONS OF ENTRY:
Use of winner's name: By entering, each entrant grants permission, without further compensation, to sponsor and their agents and licensees, to use the entrant's name, voice, photograph, likeness and biographical material for broadcast and promotional purposes in connection with the Sweepstakes.
Execution of Affidavit and Release: By entering, each entrant agrees that if selected as the winner, he/she will sign a release and waiver of liability. The prize will be forfeited and awarded to another entrant if the winner does not execute the prepared form of release and waiver or if the selected winner is not eligible in accordance with these rules.
Release Station and Sponsor of Liability: By entering, entrants agree to release sponsor's and satiation's respective officers, directors, employees, franchisees, licensees, representatives & agents from any claim, loss, liability, damage or injury of any kind arising from the entrants' participation in this Sweepstakes or their receipt or use of any Sweepstakes prize won. Sponsor shall have no liability and will be held harmless for any liability, loss, injury or death to entrant or any other person, including without limitation, damage to personal property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize by winner.
No Prize Substitutions: No substitute prizes are available; however, Sweepstakes Sponsor may, at their discretion, substitute prizes of equal or greater value. Prize is non-transferable and has no cash equivalent.
No Warranties: By entering, each entrant agrees and acknowledges that Sponsor have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relating to any of the prize items, including but not limited to, the quality, merchantability, habitability, mechanical condition, or fitness of the prize items.
Information submitted in Internet entries, including entrant's name, address, e-mail address, etc, shall be used only in a manner consistent with the consent given by entrants at the time of the entry, with these Official Rules and with CW33's online privacy policy, which can be found at cw33.com. Sweepstakes shall be governed and enforced pursuant to Texas law, excluding choice of law provisions. The Sweepstakes and all of the related pages, contents and code are copyrighted by Sponsor. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited. This Sweepstakes is not intended for gambling. If it is determined that a entrant is using the Sweepstakes for gambling purpose, they will be disqualified and reported to authorities.
INTERNET/FORCE MAJEURE:
If for any reason, this Sweepstakes is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause which corrupts or threatens the administration, security or integrity of the Sweepstakes, Sponsor reserve the right, in its sole discretion, to terminate or suspend the Sweepstakes or any portion of the Sweepstakes. ANY ATTEMPT TO DAMAGE OR UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS SWEEPSTAKES WILL RESULT IN DISQUALIFICATION FROM THE SWEEPSTAKES. Sweepstakes shall be governed and enforced pursuant to Texas law, excluding choice of law provisions.
OFFICIAL RULES OR WINNER LIST:
For an Official Winners List or a copy of these Official Rules, send a self-addressed, stamped envelope to KDAF-TV, "BLUE BELL PEE WEE PATRIOT SWEEPSTAKES", 8001 John W. Carpenter Freeway, Dallas, TX 75247. The Winners List will be available after the winner has been verified and the prize has been awarded.
